The plaintiff is registered owner of the domain name “uzleticegtudakozo.hu” (business inquiry). Three years later the defendant started to use the domain name “uzleticegtudakozo.com”.
The plaintiff sued the defendant for unfair competition.
The plaintiff is the Polish owner of the international device mark SATEL registered in 2001. He sued the defendant in 2008, whose predecessor let the domain name “satel.hu” registered in 2001 and since 2000 he in commerical contact with the exclusive agent in Hungary of the plaintiff in Hungary. Both parties offered products for safety technique.
The owner of the device mark SATEL sued the user of the domain name "satel.hu" for trademark infringement.
The applicant filed a trademark application for the registration of the word mark BOSS with the Hungarian Intellectual Property Office in class 32 for beer, mineral water and other non-alcoholic beverages. Against this application, DANUBIA Patent & Law Office filed an opposition on behalf of the owner of the marks BASS (both word and device marks) registered for beer.
The French Bongrain company is owner of 11 Hungarian national marks and a CTM one with the term and figure of MEDVE (BEAR) which is reputed and appreciated by the Hungarian public, considering good quality of the cheese for which it is used and for the long use of the mark.
